CLIENTS’ REVIEWS OF JAMES DUNN

As a 2nd offender, T.M. refused the breath test and lost his license for 3 years. At trial, cop testified to a strong odor of alcohol, bloodshot, glassy eyes and slurred speech. On the balancing tests, he swayed and "raised his arms like an airplane". After winning a not guilty verdict from the jury, we presented the judge with a fully prepared Motion to restore his license and overturn the 3 year suspension.

Police report indicated Sarah was unsteady on her feet, had a strong odor of alcohol, and  failed the one leg stand and walk and turn test.  At the station, she took the breathalyzer and blew a .19, almost two and one half times the legal limit.  In the almost two years it took to reach trial, Aty. Dunn negotiated the exclusion of the breath test and then convinced the jury there was reasonable doubt.  Not guilty of OUI 2nd offense and not guilty of reckless driving.

Cop saw Sarah cross marked lanes 5 times. Her speech was slurred and she failed all the field tests. After refusing the station breath test, we overturned her 3-year RMV suspension so she drove legally awaiting jury trial. There, although 3 cops testified against her we kept out both a damning video and medical records showing her blood alcohol was twice the legal limit. We then argued Sarah behaved completely normally at roadside before cops grabbed and arrested her and also stressed she did the balancing tests in flip flops, after midnight, exhausted and on her way to her second job.    JURY VERDICT: NOT GUILTY 

'Cop wrote that I had an extremely strong odor of alcohol, red, glossy and bloodshot eyes and ordered me out of my car. After the arrest, they found two alcohol nips in the front seat area. During the year and a half they represented me, they prevented the charge of felony third offense being filed. When the cop failed to show for the second time on a motions date, attorney Dunn vociferously argued that the case was taking too long and the cop didn't bother to notify the court he wasn't going to be there and that the only appropriate remedy was dismissal of all the charges. The judge agreed. 

But he didn't stop there! Attorney Dunn had fully prepared beforehand for this eventuality. He immediately presented a previously drafted motion (see the link below) to restore my license and the judge signed it the same day, overturning my five year refusal suspension.'

These two men are excellent at what they do and were kind to me as well. They know their job inside and out. I wish I could use Attorney Dunn for all my legal needs but he does OUI defense only.  He was personable, protected my money and watched over me.  Their job was to protect me. They did it and they'll protect you too.

I can't believe how hard attorneys Waldbaum and Dunn worked for me. First, they got my 5 year refusal suspension overturned. Then they went back to the other courts where I had at least 2 OUIs from 30+ years ago. They found my old records and convinced the judge to treat me as a first offender instead of a third. Here is what they avoided for me:

• a felony conviction
• six months in jail
• 13 years with no license

"I was sure I was going to jail but Joe proved my first OUI shouldn't count against me. Client totaled his car and another. He then failed the field tests and the station breath test with a .15 -- almost twice the legal limit. I immediately drew up and filed a motion to preserve the booking video. This showed the officer failed to observe him for a full 15 minutes immediately preceding the breath test. After four hearing dates addressing this, the judge threw out the breath test. Then, at trial, despite otherwise damning testimony, the trial judge said that the client's excellent appearance on the booking video created reasonable doubt and acquitted him.

Client was found sleeping in his car which was parked facing the wrong way on a one way street. He took a full three minutes to find his license, was unsteady on his feet when he exited and failed all the field sobriety tests, including the one leg stand and the 9 step walk and turn. I argued that the lateness of the hour and the extremely cold weather created reasonable doubt. The judge agreed and then restored his license, overturning his three year refusal suspension so he can now drive legally again and support his family.

Client was reported as an "erratic operator." Cop approached him, was overwhelmed by an odor of alcohol, his eyes were glassy and bloodshot and his speech slurred. At trial, attorney Dunn argued he was able to produce his license and registration with no difficulty and performed well on the one leg stand test at 3 AM.  Judge quickly found him not guilty and ordered 3 yr. refusal suspension removed. When RMV refused to return license, attorney Dunn went to Board of Appeals who ordered RMV to do so.

Cop saw client driving with two tires in opposite lane for 50 yards. When asked for license, he gave cop Walmart receipt. He failed the one leg stand and alphabet test with allegedly "slurred" speech and blew a .13 at the station. First we negotiated the exclusion of the breath test. Then, the booking video we obtained showed him entering the station handcuffed behind his back yet walking and talking perfectly normally. This created the necessary reasonable doubt.

Bert also told the officer he had his last drink 1 hour before the stop and was arrested after doing field sobriety tests.  At the barracks he took the breathalyzer test and failed it. At trial, attorney Dunn argued he was able to produce both documents without issue showing nothing wrong with his fine motor skills and he exited the car perfectly normally and walked perfectly normally creating the necessary reasonable doubt. Judge found him not guilty.  He was also found not responsible  of the other two charges.

I thought I was dead to rights. I blew a. 26 on the breath test which was 3 times the legal limit. Somehow, James got the DA to agree to keep it out of evidence against me at trial. Plus, the civilian caller who followed me  also showed up at trial and took the stand but James pointed out inconsistencies in his testimony. There was even a bad video but James totally turned that around on them. He's a rock star.
