Cop said Stephen was driving "with two tires in opposite lane for 50 yards." He failed the one leg stand and alphabet test with slurred speech and blew a .13 at the station. First, we negotiated the exclusion of the breath test. As a result of our timely motion, the booking videowas preserved and it showed him entering the station cuffed behind his back yet walking and talking perfectly normally. The preserved officer's dash cam video showed Stephen's driving was perfectly normal despite a very winding road. The jury found reasonable doubt and acquitted him of both criminal charges.
